Terms of Service

1. Acceptance of Terms

By accessing or using KinMeUp ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users of the Service.

2. Description of Service

KinMeUp is an AI-powered family calendar application that allows users to upload school newsletters and other documents to automatically extract and sync events to Google Calendar. We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.

3. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms.

4. Account Registration

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. User Content

You retain ownership of any content you upload or create through the Service ("User Content"). By submitting User Content, you grant us a limited, non-exclusive, royalty-free license to process and use that content solely to provide the Service to you. You represent and warrant that you have all necessary rights to submit the User Content and that it does not violate any third-party rights.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any regulations.
  • Upload content that is harmful, fraudulent, or infringes on third-party rights.
  • Attempt to gain unauthorized access to any part of the Service or its systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Use automated means (bots, scrapers) to access the Service without our permission.

7. Third-Party Services

The Service integrates with third-party services such as Google Calendar. Your use of those integrations is subject to the respective third party's terms and privacy policies. We are not responsible for the conduct or content of third-party services.

8. Intellectual Property

All rights, title, and interest in and to the Service (excluding User Content) are and will remain the exclusive property of KinMeUp and its licensors. Our trademarks, logos, and service marks may not be used without our prior written consent.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KINMEUP AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless KinMeUp and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your User Content, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. All provisions of these Terms that by their nature should survive termination will survive.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in the United States.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
